These Terms of Service (“Terms”) govern your access to and use of Cookback, operated by Sousy LLC (“Sousy,” “we,” “us,” or “our”). By using Cookback, you agree to these Terms. If you do not agree, please do not use the app.
Cookback is a private cooking journal that helps you write down what you did, look back on your own cooks, and cook it better next time.
1. Acceptance of terms
By using Cookback, you confirm that you have read and understood these Terms, agree to be bound by these Terms and our Privacy Policy, and meet the eligibility requirements below.
2. Eligibility
You must be at least 13 years old, or the applicable age of digital consent in your jurisdiction, to use Cookback. If you are under 18, you confirm that you have permission from a parent or guardian. You may not use Cookback if you are barred from doing so under applicable law.
3. License and personal use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Cookback for your personal, non-commercial use. You may not resell, redistribute, sublicense, or use Cookback for a commercial purpose without our prior written consent.
4. Your content is yours
You own the notes, photos, dishes, tags, lessons, and other content you add to Cookback. We claim no ownership over your cooks.
You give us permission to use, host, store, reproduce, process, display, format, and transmit your content only as needed to operate Cookback, provide features you request, process AI requests, provide support, maintain security, and comply with law.
You are responsible for the content you choose to record and for making sure you have the right to add it to Cookback.
5. Imported recipes and third-party content
Cookback can start a note from a recipe link you paste, such as one from the web, TikTok, YouTube, or Instagram. When you import a recipe:
- The imported content is used to set up a note in your private journal for your own personal, non-commercial use.
- Where available, we keep a reference to the original source, such as the source link, so you can credit and revisit the original.
- Recipe creators, websites, and platforms keep their own intellectual property rights in their content. Importing a recipe into Cookback does not transfer those rights to you or to us.
- You are responsible for making sure you have the right to import and use the content for personal purposes, and for respecting the terms of the original source.
Links to third-party sites, platforms, and content are provided for your convenience. We do not control and are not responsible for third-party websites, services, or content.
6. AI-generated content
Cookback may generate recaps, summaries, tags, answers, dish groupings, lessons, or other outputs automatically using AI. AI-generated content may be wrong, incomplete, or based on limited notes.
- Accuracy: verify important details, especially cooking times, temperatures, and food safety.
- Variability: similar notes or questions may produce different results at different times.
- Your judgment: you are responsible for evaluating AI-generated content before relying on it.
- No guarantees: we do not guarantee that AI-generated suggestions will work, taste as expected, or meet your needs.
Cookback is designed to reflect your own notes back to you, not to replace your judgment or professional guidance.
7. Food safety, kitchen safety, and health
Cookback is a journal, not a medical, nutritional, food-safety, or safety professional. You are solely responsible for safe cooking and safe use of your kitchen, grill, smoker, oven, appliances, tools, and ingredients.
- Cook foods to safe internal temperatures.
- Store, thaw, and handle ingredients safely.
- Avoid cross-contamination.
- Check freshness, expiration dates, and recalls.
- Identify and avoid allergens.
- Use proper ventilation, especially with grills, smokers, combustion appliances, and high-heat cooking.
- Follow manufacturer instructions for all equipment.
- Prioritize fire safety, sharp-object safety, and hot-surface safety.
If Cookback or any AI-generated output suggests something that seems unsafe or inappropriate for your situation, do not follow it.
8. Purchases and paid features
Cookback may offer paid features, one-time purchases, subscriptions, trials, or promotions. The exact terms are shown at the time of purchase.
If you purchase through an app store, payment, renewal, cancellation, refunds, and purchase management are handled by that platform according to its rules. For Apple App Store purchases, you can manage subscriptions and refunds through your Apple ID and Apple’s purchase systems.
We may change prices, features, limits, or availability in the future, subject to applicable law and platform rules.
9. Prohibited behavior
You agree not to:
- Use Cookback for any illegal purpose or to violate any law.
- Upload or share content that infringes another person’s rights.
- Upload malicious code, viruses, or harmful content.
- Attempt to access another user’s data or our systems without permission.
- Interfere with or disrupt Cookback’s servers, networks, security, or usage limits.
- Reverse engineer, decompile, scrape, or automatically extract data from Cookback except where allowed by law.
- Resell, sublicense, or redistribute Cookback without authorization.
10. Copyright and DMCA
We respect the intellectual property rights of others and expect you to do the same. If you believe content available through Cookback infringes your copyright, send a written notice to legal@cookback.app that includes:
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you claim is infringing and enough detail for us to locate it.
- Your contact information, including name, address, phone number, and email.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
- Your physical or electronic signature.
We may remove or disable access to material claimed to be infringing and, in appropriate cases, limit or terminate access for repeat infringers.
11. Feedback
If you send us ideas, suggestions, or feedback about Cookback, you agree that we may use them without restriction, obligation, or compensation to you. Feedback is voluntary and helps us improve the app.
12. Service changes and availability
We may add, change, suspend, limit, or remove features at any time. We may also suspend or stop the service, with or without notice, to the extent permitted by law. We are not responsible for loss or harm resulting from changes, interruptions, or unavailability.
13. Backups and data loss
We work to keep Cookback reliable, but you are responsible for keeping any backups you need. Device backups, exports, or platform sync features may help preserve a copy of your journal where available.
To the extent permitted by law, we are not responsible for lost, damaged, or deleted journal data.
14. Termination
You may stop using Cookback at any time. We may suspend or terminate access if you violate these Terms, create legal or security risk, misuse the service, or if we discontinue Cookback. Upon termination, your right to use Cookback ends immediately.
15. Disclaimers
Cookback is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that Cookback will be uninterrupted, secure, error-free, or that results or information obtained through Cookback will be accurate or reliable.
16. Limitation of liability
To the fullest extent permitted by law, Sousy LLC and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, use, goodwill, or other intangible losses; cooking results; food safety issues; allergic reactions; illness or injury; or reliance on AI-generated content.
In any case, our total liability for any claim arising out of or relating to these Terms or Cookback will not exceed the amount you paid us for Cookback in the three months immediately before the event giving rise to the claim, or $10 if you paid us nothing, unless applicable law requires otherwise.
17. Indemnification
You agree to indemnify and hold harmless Sousy LLC, its officers, directors, employees, contractors, and affiliates from claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising from your use of Cookback, your content, your violation of these Terms, or your violation of another person’s rights.
18. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law principles. Any disputes arising from these Terms or Cookback will be subject to the exclusive jurisdiction of the state and federal courts located in Texas, unless applicable law requires otherwise.
19. International users
Cookback is operated from the United States. If you access Cookback from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
21. Entire agreement
These Terms, together with our Privacy Policy, are the entire agreement between you and Sousy LLC regarding Cookback, and they supersede any prior agreements or understandings on that subject. Our failure to enforce any provision is not a waiver of that provision.
22. Apple App Store
If you access Cookback through the Apple App Store, these Terms are between you and Sousy LLC only, not Apple Inc. Sousy LLC, not Apple, is solely responsible for Cookback and its content.
Your license to use Cookback is limited to a non-transferable license to use the app on Apple-branded products you own or control, as permitted by Apple’s usage rules. Apple has no obligation to provide maintenance or support for Cookback.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
23. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the app, by email, or by another reasonable method where appropriate. Continued use after an update means you accept the revised Terms.
